1. The Seller

These Terms govern your use of the Nutrition Tracker application and related services (the "Service") provided by The Rosewood Group ("we", "us", "our"). By using the Service you are entering into a contract with The Rosewood Group.

2. Acceptance

By accessing, registering for, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction and, if acting on behalf of an organization, that you have authority to bind it.

3. The Service

The Service helps you log meals, analyze nutritional content (including via AI photo analysis and barcode scanning), and track daily intake. The Service is provided for general informational and tracking purposes only and does not constitute medical, nutritional, or professional advice.

4. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose;
  • Infringe the intellectual property or other rights of any person;
  • Send spam or transmit malware, viruses, or other malicious code;
  • Probe, scan, scrape, or otherwise interfere with the security or integrity of the Service;
  • Attempt to reverse engineer, decompile, or circumvent technical limits of the Service.

5. Accounts & Accuracy

You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

6. Intellectual Property

The Service, including all software, content, design, branding, and documentation, is owned by The Rosewood Group and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan. All other rights are reserved.

7. Payments & Subscriptions

Paid plans are billed in advance on a recurring basis (monthly or annually) until canceled. Prices are displayed on our pricing page and may be updated from time to time with notice. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. For refunds, please also see our Refund Policy.

8. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension & Termination

We may suspend or terminate your access to the Service in the event of: (a) material breach of these Terms; (b) non-payment of fees; (c) security or fraud risk; or (d) repeated or serious violations of our policies. You may stop using the Service at any time.

10. Disclaimer & Liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability to you for any claim arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
